Terms of Use
Agreement
These Terms of Use (“Terms”) govern access to and use of CrackTrace, including the mobile field app, related web experiences, and organization services (the “Service”). By accessing or using the Service, you agree to these Terms on behalf of yourself and, if applicable, the organization you represent.

B2B SaaS service
CrackTrace is a business-to-business software service for foundation repair organizations. It helps authorized field users capture inspections and generate postcard leads and related follow-up workflows. The Service is provided on a subscription or otherwise contracted basis to customer organizations.
Invite-only accounts
Access is invite-only. There is no public self-signup. Accounts are provisioned for organization field users by a CrackTrace platform admin. You must keep login credentials confidential and notify us promptly of unauthorized use.
You may use the Service only if you are authorized by a customer organization with an active CrackTrace arrangement.
Acceptable use
You agree not to:
- Use the Service for unlawful, deceptive, or harmful purposes
- Upload or process content you do not have rights or authority to use
- Attempt to access other organizations’ data or bypass access controls
- Interfere with the Service, including probing, scraping at abusive volume, or introducing malware
- Reverse engineer the Service except where such restriction is prohibited by law
- Misrepresent affiliation with CrackTrace or a customer organization
Customer organizations are responsible for how their users capture, store, and use lead and homeowner-related information in accordance with applicable law and their own policies.
Content and branding
Organizations may supply branding, templates, and lead content for use in the Service. You retain rights in your content, and grant CrackTrace a limited license to host, process, and transmit that content solely to operate the Service (including postcard generation and related delivery).
CrackTrace and its software, branding, and documentation remain the property of CrackTrace and its licensors.
Availability and changes
We aim to keep the Service available and useful, but we do not guarantee uninterrupted or error-free operation. Features may evolve over time. We may suspend or terminate access for violations of these Terms, security risk, or non-payment / inactive organization status.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
CrackTrace is a workflow tool and does not replace professional engineering judgment, licensed inspection conclusions, or legal advice.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CRACKTRACE AND ITS SUPPLIERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNTS PAID BY THE APPLICABLE CUSTOMER ORGANIZATION TO CRACKTRACE FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY (OR, IF NONE, ONE HUNDRED U.S. DOLLARS).
Some jurisdictions do not allow certain limitations; in those cases, the above limits apply only to the extent permitted.
